How do I make a creditor stop using new collection agencies for a debt that I have disputed 3 times?
I transferred my phone service to a new carrier. The transfer took over 3 months during which time the original carrier continued to bill me. When I checked on the status of my request, the new carrier was repeatedly stonewalled by the original carrier. It wasn’t until I removed several premium services that the original carrier finally reliquished. I am being billed for the 3 months. The carrier keeps using a new collection agency every time I dispute the debt.
While you attribute the string of collection agencies to the phone carrier. That may or may not be the case.
It may actually be the collection agencies that are doing this. It very well may be that the phone company is not the one causing the cycle of assignments for collection.
It doesn’t really matter to you who is responsible for it, you need it to stop!
If the debt was properly disputed, it would be illegal for it to simply be assigned to a new collection agency.
The Fair Debt Collection Practices Act imposes severe penalties for continuing to collect debts that have not been validated after a proper demand. It does not allow creditors and collection agencies to get around that simply by assigning the alleged claim to someone else.
If your dispute was done properly, it should be a violation of the Fair Debt Collection Practices Act to continue assigning the debt to one collection agency after another.
Certainly, there are some collection agencies and creditors that consider themselves above the law and sell those debts to others in spite of the restrictions against doing so. However, most will not.
You say that you have had several new collection agencies contact you about this disputed claim.
That tells me that, either you have run into a string of scoff-laws, or your demand was not properly submitted to trigger the ban on further collection activities.
You also need to check your credit report to see if each collection is noted on it.
In all likelihood, each time your phone carrier (or whomever) assigned the debt to a collection agency, it was reported on your credit report.
Even though it is the same debt, each derogatory listing hurts your credit score, over and over again.
They may be causing you serious harm.
You should also consider engaging the services of a reputable credit restoration service, one that has a demonstrable track record of success over several years.
Such a service can get the repeated, duplicated collections permanently and legally removed from your credit report and may even be able to get the underlying debt removed as well.
It would also be able to properly frame your dispute to trigger the Fair Debt Collection Practices Act.
Some credit restoration services have in house attorneys who can take it to the next level, threat of reporting violations to the FTC, if the practice of simply assigning the debt to a new collection agency continues.
